Judge Tosses Confession in Lunsford Case

Some regional news that hits a little close to home.

In 2005, 9 year old Jessica Lunsford was abducted. Jessica lived in my "Florida home" of Citrus County. It was the kind of horrific crime that inflames an entire community. My nieces assisted in the search. Weeks later, Jessica was found buried, dead, clutching a stuffed animal.

John Evander Couey was arrested in Augusta, Ga. on an unrelated charge and in questioning by Florida law enforcement confessed to the killing.

Now, Florida Circuit Judge Ric Howard has disallowed that confession. Couey alledgedly requested an attorney and was denied. Judge Howard is still allowing the very damaging evidence discovered in Couey's trailer that led to the discovery of Jessica's body. This evidence alone may be enough to convict Couey.

On the basis of the initial news report, I believe the judge was right. I also believe that Couey will still be convicted.

This entire case brings backs unpleasant memories of Georgia's Alday murders. That horrible day and its aftermath in 1973 haunted the Donaldsonville community for 30 years.

No matter what happens in the Lunsford case, my hope if that justice is done and the community will be able to heal and move on.

Truth, Justice and The Radical Right's Way

Going in to see "Superman Returns", I knew that a few wackos were up in arms over a modification of Superman's traditional slogan of "Truth, Justice and The American Way".

In the movie, acerbic Daily Planet editor Perry White mutters, "Truth, justice and all that stuff".

Now let me provide a little vocabulary lesson for some people.

Context:


  1. The part of a text or statement that surrounds a particular word or passage and determines its meaning.
  2. The circumstances in which an event occurs; a setting

The point of the scene in question is that White is less concerned about the importance of Superman's return or for what he stands. He only wants to sell newspapers. "All that other stuff" is merely a means to an end for a machiavellian White.

Later, Jimmy, Lois and Perry are peering at a blurry photograph and question if it's a "bird, a plane...oh hi Cark!" as Clark Kent walks in. It's apparent from these types of quips that the screenwriters want to both honor and deconstruct the Superman mythos. As with the "truth, justice and the American way" having people wildly exclaim about the identity of some flying object on a piece of paper would seem a bit dated. We do not live in the era when these catch phrases were as ingrained in the conscious. Despite the wishes of some, we do not live in the 50's.

Finally, it is also evident that the screenwriters did make a conscious decision to exclude the words "the American way". They of course understand that the words may have a very different meaning in the rest of the world. I'm sure the studio executives understand that the rest of the world means box office. The majority of a movie's take these days occurs overseas. So would it be wrong to alter the script in order to sell more tickets in other countries? If you believe in free markets, the answer would be a resounding no. If you pretend to believe in businesses making sound economic choices unless they diverge from your agenda then apparenty the answer is a loud YES. It always strikes me as funny how supposed "free marketers" are suddenly very critical of corporate decisions when they find them distasteful.

In conclusion, to those of you who want to make a mountain out of a script change, I have two words.

Grow up.

A Thought On Hamdan

I'm going to leave the legal subtleties to others.

Instead, I want to note the lead defense attorney on the case. His name is Charles Swift and he is a Lt. Commander in the U.S. Navy.

It seemed a bit odd to see a man in dress blues standing in front of the Supreme Court talking about winning a case against the current administration. Swift was gracious with none of the usual lawyerly hubris that accompanies these circuses.

Even more striking was the comments by Swift after the press conference. Interviewed by a CNN reporter, he was asked his feelings about arguing a case essentially against his superior, the commander in chief, in the chain of command.

Swift pointed out that it had happened several times in history and that he was, like President Bush, bound to defend the Constitution. He concluded by emphasizing that his participation and a peaceful resolution to a difficult problem exemplified the beauty of our system.

Amen, Commander Swift.

These are cynical times and it's easy to see only the difficulties. In the midst of all the wailing and gnashing of teeth, it is important to remember that despite all its flaws, our form of government is still the best anyone has ever devised.

Now the Jeruslaem Post is reporting an 18 year old Israeli hostage has been executed.

Meanwhile, the main "news" channels are once again running re-runs.

This includes CNN's "Headline News" which is showing a repeat of Glenn Beck.

Superman Returns Open Thread

I'm going to see it this afternoon. Feel free to express yourselves on this movie, the 70s version, George Reaves mysterious death or the inevitable geekiness of a guy who calls himself griftdrift.

Why The Evolution Battle Matters

It's a quiet but hot war. Occasionally, it will flare to the level of national attention in places like Kansas and Dover, but most of the battles are small firefights at the local level. Most of the attacks are subtle and many times personal. Despite the cries of some that it is a lesser issue in the grand scheme, creation and evolution battles occur in the country constantly. Most times, it is a local school board roiled in handwringing. But frequently, it's a single voice trying to do what is right against almost incomprehensible pressure from friends, colleagues and community.

Recently, the single voice that stood up was Lumpkin County Middle School science teacher Pat New.

On April 25, 2005, during a meeting about parent complaints with her principal, Rick Conner, she recalled: "He took a Bible off the bookshelf behind him and said, 'Patty I believe in everything in this book, do you?' I told him, 'I really feel uncomfortable about your asking that question.' He wouldn't let it go.' " The next day, she said, in the lunchroom, "he reached across the table, took my hand and said: 'I accept evolution in most things but if they ever say
God wasn't involved I couldn't accept that. I want you to say that, Pat.' "

Fortunately for Ms. New, the state of Georgia educational standards explicitly require the teaching of evolution as the unifying concept for biology. Instead of having to enter the mud wrestling minutiae of the creation / evolution debate, she was able to say I must teach the standards. She did have to file a grievance but once she did the local school officials had nowhere to turn.

She almost didn't have that opportunity. Two years ago, State School Superintendant Kathy Cox made a move to eliminate evolution as a standard. If she had been successful, not only would Ms. Pew have suffered the fate of a pariah in her community but her students would have suffered an inadequate education.

No issue in the past 20 years has crystalized the importance of local attention like the debate over the teaching of evolution. While national attention is focused on abortion, the war and flag burning, evolution opponents coordinate grass roots movements to take over local and state school boards, paste stickers in biology books and pressure individual teachers.

Educators and scientists continually fight the quiet war to preserve and improve the education of our future generations. Isn't that worth a little of our attention?

First, I post the story from the Palatka Daily News that Katherine Harris has lost the last little parcel of her mind and of course a fave blog St Pete Times Buzz picks it up as well. Credit for griftdrift? None. Bastards! (okay, they are a major daily who probably have rules against polite linking. whatever.)

But insult to injury, I tip Wonkette that Jack Kingston has an unintentionally funny post on his blog about "getting to know" interns. Just maybe a tiny little hat tip? None. Bastards!


Fittingly, I am doing all this while watching My Life On The D-List with Kathy Griffin.

Well, at least you know I am not one of those zombie rabid lambs that Kos controls.

Pamela Hasterok of the Daily Dayton News laments that Katherine Harris should be a "dream" candidate.

But high-level Republicans are attacking her candidacy more intently than a
vulture dive-bombing road kill.

It's the strangest thing I've ever seen.

Oh The Irony

It is delicious.

My own unscientific opinion is that Atlanta follows only Los Angeles (and maybe Houston) in its addiction to the automobile. Our orgy of single occupancy driving has led to one of the worst air qualities of any U.S. city. Summers are particularly bad. So far 11 days in June have warranted a smog alert with 6 of those days being designated unhealthy to sensitive groups (source: Georgia DNR).

So what is the MoveOn.org's idea for action to combat these issues?

Have a rally! Where you have to drive! During rush hour! To the busiest intersection in Atlanta!

We need to seize this moment to make sure the media and the public know that the

More On Kos

Hey! It's almost a requirement that when a blogstorm happens everyone must jump in the pool!

Remember a few months ago when I attended a Kos event here in Atlanta?

After familiarizing myself with Kos, I was a little surprised by his rather moderate stance on certain items. Particularly meta-strategies for getting democrats elected. Most of my reading up to that point indicated that he did not believe in mollifying the middle. In fact, among the Kossacks, I had always felt that a certain amount of disdain was thrown the way of the moderates.

In relating a story about Richard Morrison's 2004 run against Tom Delay, Kos surprised me by in essence saying that pro-choice groups had been wrong to abandon Morrison simply because he expressed a personal view opposing abortion.

Kos paraphrase: Single issues are not worth losing the whole game. Once we
are in power, things will be worked out.

Months later, Mark Warner appears to have been the belle of the ball at Kos' annual convention, YearlyKos. Mark Warner who wears the shining mantle of moderate like no other. Mark Warner who has personally expressed opposing abortion but also believes that the goverment shouldn't interfere. Mark Warner who hired Kos Crashing The Gates co-author Jerome Armstrong.

Kos appears in Atlanta surprising griftdrift with his talks of moderation. Mark Warner, the uber-moderate, makes a prominent appearance at YearlyKos. Jerome Armstrong is hired by Mark Warner. Rumors of pay for play swirl on the internets.

Some Not So Final Thoughts On The Cup

It's a beautiful thing drinking a Guiness and eating eggs at 9:30 in the morning. Unfortunately, what the U.S. squad executed on the pitch was far from beautiful. Yeah, we got jobbed on a few calls but the fact is we did not play well and we got what we deserved. As much as I like Landon Donovan and Eddie Lewis, in the end we looked old and tired. My hopes are the federation moves towards youth for 2010.

Finally, I would implore my fellow Americans to not give up on this year's edition of the Cup. All too often the rest of the world is correct that once the American's are eliminated we simply turn elsewhere. Despite the glut of yellows, this has been a beautiful tourney so far. There are many interesting teams and many fascinating stories still to tell. So despite the boys not being there, continue to tune in American's. You just might find you like it.

A Physics Moment

DaveScot has topped Newton and Einstein, in his mind at least, by turning the physics world on its head by declaring gravity "the strongest force in nature".

First a bit of a blogsphere primer. DaveScot is less a thorn in the side, more of the Intelligent Design court jester who's never-ending hijinks provide great fodder for the good people at Panda's Thumb, Pharyngula and Dispatches From The Culture War.

One of the most frustrating parts of the Creation / Evolution debate is the subject of gravity. It is not in the nature of scientists to compare one theory to another in some sort of sliding scale. For the most part it is the proverbial apples and oranges.

However, a useful tactic is to explain to someone that currently more is known about evolution than gravity. This can be a real headscratcher as we experience gravity in everyday life. (We also experience evolution but it's just not as noticeable).

The shock of a scientist stating that something so well known is far from understandable will inevitably lead to one of two reactions. Hopefully, the person will be thoughtful and ask why. Unfortunately, most people respond with something along the lines that if you don't understand something so basic as gravity then you should go jump off a building and learn for yourself.

This is the point where scientists begin pulling their hair out since the abhorrent science learning in the U.S. education system has left many people confused with the evidence of something and the understanding of how that something works. Yes, things fall because of gravity. That is evidence of gravity's existence. Why things actually fall gets a bit weirder. It's a crazy world of relativity, curves in space and the bizarre quanta.

But back to DaveScot.

One thing that we do know is that compared to other forces in the universe gravity is fairly weak.

Don't believe me? Get up off the couch.

You just overcame the force of gravity. The force of the entire earth (in addition to your couch) was attempting to hold you down and was overwhelmed by a few muscles in your legs and back.

Need more convincing?

Try this simple experiment.

Take two good sized magnets. Now place them north pole to south pole. We all know how this works from grade school. The two magnets will click together bound by the electromagnetic force. Now pull them apart. Not too terribly difficult unless you got some really big magnets.

Now take one of the magnets on the floor. Now pick it up.

You tell me. Which action required more force?

That gravity is a fairly weak force is something every high school student should easily understand.

But apparently no so easy for DaveScot.

Torture

One of my greatest fears is the further we race into the future, the more we will discover the heinous deeds that were done for expediency.


Matt Yglesias sums up one section of Ron Suskind's new book "The One Percent Doctrine" nicely:


Al-Qaedist Abu Zubaydah was captured in March 2002.

Zubaydah's captors discovered he was mentally ill and charged
with minor logistical matters, such as arranging travel for wives and children.

The President was informed of that judgment by the CIA.

Two weeks later, the President described Zubaydah as "one of the top
operatives plotting and planning death and destruction on the United States."

Later, Bush told George Tenet, "I said he was important. You're not going
to let me lose face on this, are you?" and asked Tenet if "some of these harsh
methods really work?"

The methods -- torture -- were applied.

Then, according to Gellman, "Under that duress, he began to speak of plots
of every variety -- against shopping malls, banks, supermarkets, water systems,
nuclear plants, apartment buildings, the Brooklyn Bridge, the Statue of
Liberty."

At which point, according to Suskind, "thousands of uniformed men and women
raced in a panic to each . . . target."


People oppose torture for many reasons. From the humane to the practical. In my opinion they are all correct. But for you Rambo-heads out there who still believe if we just go all Jack Bauer on people, we would start winning the war on terror, exactly what would make you believe that torture is not only un-American but also ineffective?

Are The Left and The Right The Same?

I think most agree both have their share of loons.

However, the (admittedly leftist) Guardian presents a thought provoking analysis of access versus quantity.

Conservatives invariably trot out filmmaker Michael Moore, cartoonist Ted
Rall, professor Ward Churchill, or Air America radio personalities Mike Malloy
and Randi Rhodes as examples of progressives who prove the myth, but the

An Alternative To The NRA

Finally, something I have been seeking for years.

Disclosure: I like guns. I currently own five. Three shotguns, one rifle and one pistol. I also like hunting. I hunt deer, dove and quail. This fall I plan to attend more hunts than I have in the past. If I don't bag a buck this year I will be disappointed.

Now back to the new American Hunters and Shooters Association.

In recent years, extreme political positions purporting to support gun rights
have jeopardized our sport and have hurt the image of responsible gun owners.
Unless the sporting community can become unified behind an organization that
fights for safe and responsible hunting and shooting practices and sensible gun
ownership, future generations may be unable to participate in and enjoy the
shooting sports.


I have always firmly believed that the NRA does more harm than good. I have also firmly believed that many gun laws are daft and useless. Many, not all. A key word that the NRA seems to not understand.

Opposing restrictions on "cop killer" bullets despite protestations of police organizations is probably the best example of the NRA's bull headed banging into trees despite the forest attitude. The result of these types of absolutist positions continues to push those who oppose gun ownership further towards prohibition only. It also leaves us reasonable gun owners scratching our heads.

Instead of spending any significant amount on education and gun safety, topics that resonate with both gun owners and non-owners, the NRA chose to draw a hard line and spend money on ridiculous lawsuits, illogical PR campaigns and and most importantly lining the pants of politicians who were willing to sponsor legislation to turn parts of the country back into Deadwood.

Some are already discussing conspiracy theories that this new group is a stalking horse attempting outflank the Republicans on the gun issue.

My response? So what.

If there is a gun group who is preaching responsibility, conservation and reaching out to non-owners then I could care less about the potential political Machiavellian maneuvering.

It's what the stupid NRA should have done decades ago.

Robert Byrd just passed Strom Thurmond as the longest serving Senator ever.

This piece reminded me that I heard a Byrd in 06 commercial while travelling through West Virginia. The focus of the piece was values with an emphasis on voluntary school prayer. Of course, voluntary school prayer already exists and has never been an issue. That was when a revelation hit me. You never hear Byrd accused of being a hated liberal. The right wing talk nuts always chime on his sordid past with the klan. That's all they can ever get him on. Byrd can outflank them on any issue.

I guess that's how you spend over 40 years in the Senate. Then again, I am not sure that's a good thing.

Just heard on local radio that Florida Democrat U.S. Senator Mel Martinez has endorsed Republican gubenatorial candidate Charlie Crist. Martinez ratcheting up his independant cred in moderate state of Florida? Lack of faith in the campaigns of democrats Jim Davis and Rod Smith? No matter what, Charlie Crist has to be pretty happy this morning.

CORRECTION: Maritnez is a Republican. griftdrift is an idiot. I got Martinez confused with Katherine Harris opponent Bill Nelson. My only excuse is that Florida politics is so eternally weird that I can't keep it straight. The importance of the Martinez endorsement is two fold. It gives Crist the endorsement of the most prominent national Florida Republican and it arguably gives him a leg up on the latino vote. Particularly in the south Florida Cuban community.

As I sit here in the library, Tropical Storm Alberto sits a few hundred miles off the gulf coast. We are already seeing bands of clouds overhead. Hopefully later we will see some rain. The good side of a tropical storm is it's an instant drought breaker. We have had two days of rain the past two months and we need some bad.

USA! USA! USA!

Team USA will have it's first World Cup match today at noon. They are playing a critical game against the Czech Republic. The Americans need at least a tie in this one to have hopes of moving on. Play hooky from work, find a bar and root for the team. Even if you think soccer is boring, once you see how crazy the Cup is, you will instantly fall in love.

Just woke up and heard this. The most wanted man in Iraq is gone daddy gone. I agree with Eddie Copeland. This will not make everything good and right but it's a very large step in the right direction.

UPDATE: Tony Snow is now holding a press conference. There is literally no other news on right now. Probably deservedly so.

The latest news is that either someone within Zarqawi's organization or someone in the neighborhood tipped the U.S. If true, this would be good news. No, we certainly have not been winning the hearts and minds of the Iraqis, but maybe, just maybe, neither are the foreign insurgents.

UPDATE II: Tony Snow actually just made a good point. Iraq now has a Defense Minister and an Interior Minister. This type of operation could not happen without coordination with the Iraqi government. Is it possible this would have never happened without at least a marginally organized Iraqi government? I have more thoughts on this and why it not only is a step in the right direction but why it should have been done long ago. As soon as I get that together, I will post.

While I was watching Ann Coulter flop around on Tucker Carlson, Jon Stewart was taking Bill Bennett to the woodshed over gay marriage.

Mogadishu Falls

Most Americans know Mogadishu from the book or film Black Hawk Down. What they may not know is that it is a recent front of the War on Terrorism.

Since the overthrow of its despotic government in 1991, Somalia has been Mad Max land. Warlord controlled militias rule most of the country. Their power is based on the presence of roving militias mounted in armed "technicals" (basically souped up mini-trucks with mounted machine guns). Sound familiar?

Now on the heels of the U.N. forming a nascent government, an Islamic faction, possibly linked with al-Qaeda, from southern Somalia have overwhelmed the loosely allied warlords and have taken Mogadishu.

The U.S. may soon have a new, even more unstable terrorist hotspot on its southern flank.

This certainly bears watching.

No Apparent Wrongdoing in Ishaqi

Bubbling just beneath the surface of Haditha were allegations of more deliberate killings of innocents in Ishaqi.

Fortunately the Marines involved in the Ishaqi incident have now been cleared. It is still tragic that non-combatants were killed but that does happen in war.

Due to the loss of life, it's difficult to say this is good news but it is. Instead of one incident after another piling into an avalanche, hopefully, there will now be a cooling off.

There are still serious questions to be asked about Haditha but we can't use these unknowns as justification to find the devil where he ain't.

Political Pandering Of The Day

Here we go again.

Bush is set to use radio address to renew his support for a constitutional ban on gay marriage. On Monday, surrounded by fawning, rabid supporters, he will deliver a Rose Garden a follow-up speech on the subject.

Of course there is no chance of this passing the Senate. This is pure election year pandering.

Scene From The Road - Culpepper, Va.


Downtown Culpepper, Va.

I stopped in Culpepper for about an hour. It's a lovely little downtown filled with shops and restaurants. I walked into a tavern and it had about four people in it. They all looked at me. Registered that I wasn't one of them and went back to watching TV. I didn't mind. In fact I understood.

Then I had one of the best burgers I have tasted in a while.

I will definitely visit Culpepper in the future.

Going to take an easy stroll of about 200 miles today. One reason is I want to get into the D.C. area before the insane rush hour traffic. Depending on my rate of speed, I may stop at Monticello.

It seems to be a slow morning in the news. There's two new investigations of civilian deaths in Iraq.

The foothills of the Blue Ridge

I've barely seen Lynchburg but already feel the presence of Rev. Falwell. I passed the Falwell Airport. I knew I should have asked for an interview!

This was the most pleasant ride yet. I started in flat farmlands of central Carolina, moved to the wooded piedmont of southern Virginia and ended up here looking up at the hills.

After a short breather, politics will abound!

As when I visited Manassas several years ago, I was struck by the quiet beauty. The same holds true for Appomattox. It seems so serene for a location of violence.

As I drove westward towards Lynchburg, the road began to wind and undulate. Approaching the foothills of the Blue Ridge, I was reminded of the terrible decision that Robert E. Lee let pass him by. How easy it would have been for him to move his rag tag army into these hills and conduct guerilla warfare. The Union would have spent years rooting out all the rebels. The country would have bled for years.

We still feel the echoes of Appomattox today. The wounds of war still fester at times. But on April 9th, 1865, Robert E. Lee and Ulysses S. Grant gave the young country a chance. A chance to survive and move forward.

Visit Appomattox if you are in the area. It's well worth it.

It's shocking how small the parlor is. The obviously ready to go ranger basically said everybody says that. From the paintings, you expect this massive room that held about 12 men. In reality, it's only about 10X12.

Interesting historical note. Wilmer McLean originally lived near Manassas, Va. After the First Battle of Manassas destroyed his home, he moved to far south Virginia. Then, the final battles of the Virginia campaigns happened in his backyard. Thus leading to the expression, the war started in McLean's front yard and ended in his back parlor.

This was a beautiful stretch of road. The picture doesn't do it justice. One minute I was passing rolling farmland. The next I was shooting into a tunnel of trees.

No I am not about to be t-boned. Parking in downtown is in the middle of the road. Which seems odd at first but makes a lot of sense when you see it in action.

Okay so I may have given Washington a bit of a hard time. It's not that bad. If I come through next time, I will make it down to the river front. According to the visitor's center it's supposedly very nice.

Today is a short hop to Appomattox, Va.

This is a place I have always wanted to visit. This leg will be mostly backroads and I don't want to waste any time so pictures might be a bit sparse until I actually get to the destination.

CNN just reported that in light of Haditha, all American troops will undergo values training.

Better put plywood over the Windows XP. This would be a category 5 storm.

Hurricane Season Day 1

For the next six months you are going to discover that I am a weather nut.

Growing up near the gulf coast ingrained me with a fascination for hurricanes. Last year, I admit it became a bit of a morbid fascination. Let's all pray this season is quieter.

In the meantime, the tropics are fairly tame at the moment.

If you want to keep up with the season I recommend two sites:

Palm Beach Post Storm Center - They live right next door to the National Hurricane Center and their coverage is always comprehensive.

Crown Weather Service - A comprehensive site for all updates and weather maps. Don't let the amount of geeky data overwhelm you. This is as good as it gets.

Breaking News: Chopper Crash In Doerun

Reports of an Army helicopter crashing near Doerun, Ga.

The reason this caught my eye is Doerun is about 8 miles from my little cabin in the woods.
